Amii Asynchronous Training Platform

Acceptance of Terms

Welcome to the Amii asynchronous training platform. These Terms of Service ("Terms") govern your access to and use of all training content, materials, and services (the "Services") provided by the Alberta Machine Intelligence Institute ("Amii"). By accessing, viewing, or using any part of the Services, you agree to be bound by these Terms and our Privacy Policy and Code of Conduct. If you do not agree to all the Terms, you may not access or use the Services.

Access and Use of the Services

● Grant of Access: Upon successful payment, Amii grants you a non-exclusive, non-transferable, limited license to access and view the purchased training content for your personal, non-commercial use.

● Free Access: If you receive free access to any training, these Terms still apply.

● Restrictions: You may not copy, reproduce, distribute, sell, or create derivative works from the Services or any training content without express written consent from Amii. You may not share your login credentials with any other individual.

User Conduct

Your use of the Services is subject to Amii's Code of Conduct, which is incorporated by reference into these Terms. By using the Services, you agree to abide by the principles and expectations outlined in the Code of Conduct. Amii reserves the right to suspend or terminate your access to the Services if you violate the Code of Conduct or these Terms.

Payments and Refunds

● Refund Eligibility: You are eligible for a full refund if you request it within 14 calendar days from the date of your initial purchase. You must also not have completed more than 50% of the content of a single foundational course.

● Refund Process: To request a refund, please send an email to support.brightspace@amii.ca with your full name, the email address used for purchase, the course name, the date of purchase, and a brief explanation for the refund request.

● Processing Time: If your refund is approved, it will be automatically applied to the original method of payment used. Please allow up to 14 business days for the refund to appear on your statement.

● Non-Refundable Items: The following items are not eligible for a refund: courses or products purchased more than 14 days ago, courses where a signifi cant portion of the content has been accessed or completed, any promotional, discounted, or free courses, and services or digital products that are not part of the standard online course (e.g., one-on-one coaching, downloadable guides, or other separate digital assets).

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. AMII MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING THE SERVICES, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR

PURPOSE, OR NON-INFRINGEMENT. AMII DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL AMII BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Province of Alberta, Canada, without regard to its confl ict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Edmonton, Alberta, and you consent to the personal jurisdiction of such courts.

Termination

Amii reserves the right, in its sole discretion, to suspend or terminate your access to the Services at any time, with or without notice, for any reason, including a breach of these Terms.

General Provisions

● Entire Agreement: These Terms, together with the Privacy Policy and Code of Conduct, constitute the entire agreement between you and Amii concerning the Services.

● Severability: If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed from the rest of the Terms, which will remain in full force and effect.

● Waiver: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.
